After four years of litigation, on December 28, the Pennsylvania Supreme Court issued a 4-2 precedential decision in Diehl v. Unemployment Compensation Board of Review, which holds that under the state’s unemployment compensation law, employees who accept early retirement packages offered by their employers due to a reduction in force may now qualify for unemployment benefits.
